DUII Penalties in Klamath Falls

Penalties vary based on what number of DUII you have been charged with. If you have been charged with your first DUII then your chances of avoiding any sentence are good because you can likely participate in Diversion (link to Diversion section). If however you have been charged as a repeat offender then a sentence of jail is likely if you are convicted of the DUII.

If you are convicted of your first DUII, either by pleading guilty or being found guilty by a jury at trial, then you will receive a minimum sentence as outlined below:

  • A conviction that is non-expungable
  • A minimum of two days of jail or 48 hours of community service
  • One year driver’s license suspension
  • A fine of at least $1000
  • An alcohol evaluation and minimum 90 days of treatment

FELONY DUII

If you a repeat offender of DUII in Oregon then you can be charged with a felony. If you are charged with a third or more DUII in 10 years then you will be charged with a felony. Sentences for a felony DUII charge can be significantly more severe than a misdemeanor DUII. A felony DUII carries with it a mandatory minimum of 90 days of jail. If you have been charged with your fourth DUII in 10 years then you may be sentenced to prison.

Additionally, a third DUII conviction will result in a driver’s license revocation. And once you are a DUII felon then any additional DUII you receive in your life will be a felony charge.
