Maybe. If this is your first DUII then you will very likely avoid any jail sentence because you will probably participate in diversion (link to diversion section). If you have been charged with a DUII in the past then you are at an increased risk for being sentenced to jail. Klamath County has several programs that are alternatives to jail, like home detention and community service.

WILL MY DRIVER’S LICENSE BE SUSPENDED?

Maybe. The first thing that you must do if you have been arrested for a DUII is to request a DMV Hearing (link to DMV Hearing section). You must do this within 10 days of the date of your arrest, otherwise the DMV will automatically suspend your license. In addition to the DMV suspending your license the judge will also suspend your license if you are convicted of the DUII. There are ways to avoid a conviction and a driver’s license suspension.
